Crystal Marie Hoglan

Jimmy L. Legates Sr

Crystal Marie Hoglan (DOB 6/18/79) and Jimmy Lee Legates, Sr (DOB 5/19/85). were sentenced for the July 2014 murder of their seven month old son, Alex, and the neglect of all three of their children.

The Judge sentenced Hoglan to life and Legates to 20 years in prison.

Although Hoglan told police several scenarios about what happened leading up to Baby Alex’s death the investigation ultimately revealed Hoglan used a shoe lace to strangle her infant son because he was fussy.  Hoglan and Legates were sentenced for 1st and 2nd degree murder, respectively.  Plus four counts of child neglect as the baby and his two older siblings were found in deplorable conditions including filth, piles of trash and an infestation of fleas and roaches.  The baby had reportedly been ill for at least a week but Hoglan and Legates made no effort to get medical attention until the boy became unresponsive and finally an ambulance was called.  The investigation shows the pair did have time to stop for food for themselves and the dog.

Prior to handing down Hoglan’s sentence the Judge noted how Hoglan gave multiple versions of events including trying to place the blame for her infant son’s injuries on the firefighters who responded to try and help her baby, the child’s older brother and even the dog.

Earlier during the course of the case the Judge made a finding of guilt against Legates.  The order describes the home as “a living hell” and “incubator for disease” not suitable for a sick child.  “The final act being to feed formula to the child to get him to sleep in a filth laden bedroom wrapped in a filthy pink baby blanket,” the order states.
Investigators also discovered both Hoglan and Legates made jailhouse confessions to cellmates.

Hoglan sentence:
For the murder (1st degree) – Life in prison with all but 31 years suspended.  Upon release probation and registration as a violent offender.  On the child neglect charges – 20 years on each of the four counts.  All sentences run concurrently.

Legates sentence:
For the murder (2nd degree) – 20 years in prison, four years suspended.  On child neglect 20 years with four years suspended for each count.  All sentences to run concurrently.
