36-year-old Dwayne Bruton was formally sentenced today after a jury found him guilty of six criminal charges during a trial last month.  Guilty of robbery, assault and battery, having a gun after previously being convicted of a felony, resisting an office, and concealing stolen property.

Judge Sue Nigh, who presided over the trial, handed down four, 40-year sentences today for the four felony counts, and 18 months on the two misdemeanor counts.

All counts are to be served consecutively.

On October 29, 2022, Bruton brutally pistol-whipped, stomped, robbed, and stuck a gun into the mouth of a 56-year-old man.  The victim says Bruton took his wallet containing $130.

The jury found him guilty on all six counts:

COUNT 1:      ROBBERY WITH A WEAPON  ~ 21 O.S. § 801, a FELONY

COUNT 2:      ASSAULT, BATTERY, OR ASSAULT AND BATTERY WITH A DANGEROUS WEAPON  ~ 21 O.S. § 645, a FELONY

COUNT 3:      FELONIOUSLY POINTING FIREARM  ~ 21 O.S. § 1289.16, a FELONY

COUNT 4:      KNOWINGLY RECEIVING OR CONCEALING STOLEN PROPERTY ~ 21 O.S. § 1713, a MISDEMEANOR

COUNT 5:      POSSESSION OF FIREARM AFTER FORMER FELONY CONVICTION ~ 21 O.S. § 1283(A), a FELONY

COUNT 6:      RESISTING AN OFFICER  ~ 21 O.S. § 268, a MISDEMEANOR

Through his attorney, Bruton told the judge he’s been clean and sober and found Jesus during his most recent time in jail.  He’s been in the Rogers County Jail since his November 9, 2022 arrest.

Previous convictions include domestic violence by strangulation, possessing and pointing a firearm (after former conviction of a felony) burglary, and gang-related criminal activity.
