Rogers County Jury Recommends Maximum Sentence for Man Found Guilty of DUI

21 Apr Rogers County Jury Recommends Maximum Sentence for Man Found Guilty of DUI

CM-2015-1012

Kermit L Brannon, Jr

A jury finds Kermit Lee Brannon, Jr. guilty and recommends the maximum sentence possible for driving under the influence of drugs and unsafe lane use following his not guilty plea.

A call to police on November 6, 2015 about a reckless driver brought an Inola Police Officer into contact with Brannon who was driving left of center.  Brannon then drove into a ditch as the officer pulled him over on the side of Highway 88 near the U.S. 412 overpass in Rogers County.

This was Brannon’s first DUI case but he has a long history of both felony and misdemeanor criminal convictions including possession of a controlled drug, possession of marijuana with intent to distribute, resisting an officer and obstructing an officer.

During trial because Brannon chose to take the stand the prosecutor was able to introduce Brannon’s prior felony convictions.

The jury recommends one year in prison for driving under the influence of drugs and 10 days in county jail for the unsafe lane use conviction.

A judge later sentenced Brannon to one year ten days in jail.  Brannon is appealing.

The verdict came in Monday April 18 and Brannon (DOB 07/14/78) will be formally sentenced May 2, 2016

Previous felony convictions:

Unlawful possession of controlled drug; CF-96-5756, Tulsa County
Knowingly concealing stolen property; CF-98-4175, Tulsa County
